These Terms are a legal agreement between you and Edutech Computers Ltd. By using ZamBuy you agree to be bound by them.

1. About ZamBuy

ZamBuy is an online marketplace that connects buyers in Zambia with local producers, manufacturers, farmers, artisans and service experts. ZamBuy is owned and operated by Edutech Computers Ltd, a company registered in the Republic of Zambia ("we", "us", "our"). Our role is to provide the platform; we are not a party to any sale of goods or services concluded between users unless we expressly state otherwise.

2. Governing law

These Terms are governed by the laws of the Republic of Zambia, including the Electronic Communications and Transactions Act No. 4 of 2021, the Competition and Consumer Protection Act No. 24 of 2010, the Sale of Goods Act, the Data Protection Act No. 3 of 2021, and the Cyber Security and Cyber Crimes Act No. 2 of 2021. The courts of Zambia have exclusive jurisdiction over any dispute arising from these Terms.

3. Eligibility

  • You must be at least 18 years old and able to enter binding contracts under Zambian law.
  • Sellers and service experts must be lawfully entitled to do business in Zambia and, where required, hold PACRA registration and a valid TPIN.
  • You must provide accurate and current information at sign-up and keep it up to date.

4. Accounts and security

You are responsible for activity on your account and for keeping your password confidential. Notify us immediately at hello@zambuy.co.zm if you suspect unauthorised access. We may suspend or terminate accounts that breach these Terms or Zambian law.

5. Buying on ZamBuy

  • Listings are offers by the seller, not by ZamBuy. A binding contract of sale is formed between buyer and seller when an order is confirmed.
  • All prices are in Zambian Kwacha (ZMW) unless stated otherwise and are inclusive of VAT where the seller is VAT-registered.
  • You must inspect goods promptly on delivery and raise any complaint within the timelines stated on the order page.
  • Posting a service request or quote request is free of charge for customers.

6. Selling on ZamBuy

  • Sellers warrant that they have the right to sell every product or service listed and that the listing complies with Zambian law.
  • Prohibited goods include (but are not limited to): firearms, ammunition and explosives, illegal drugs, counterfeit goods, endangered wildlife or wildlife products contrary to the Zambia Wildlife Act, stolen goods, and any item whose sale is restricted under Zambian law.
  • Sellers must honour the prices, lead times and delivery commitments shown on their listings.
  • Subscription plan limits (number of products, monthly service responses) are enforced by the platform and may not be circumvented.
  • Sellers consent to ZamBuy displaying their business name, location and verification status to buyers.

7. Service requests and the first-5 auction

When a customer posts a service request, the customer's contact details are released to a maximum of five (5) responding experts on a first-come, first-served basis. Once five experts have responded the request is closed. Customers may re-post a request, in which case the five previous experts are excluded.

Experts may only respond to requests that fall within their registered service categories and provinces.

8. Subscriptions, fees and commission

  • Listing a job or request as a customer is 100% free.
  • Sellers and service experts pay a monthly subscription in Kwacha. Fees, product limits, response limits and commission rates are shown on the Pricing page and may be updated from time to time by the administrator.
  • Where ZamBuy provides escrow, a commission is deducted from each completed order before payout to the seller.
  • Subscriptions are not refundable except where required by Zambian consumer-protection law.

9. Escrow and payouts

For supported transactions, payment is held in escrow until the buyer confirms delivery or the auto-release period (currently 7 days after delivery) expires. Funds are then released to the seller's wallet, less the applicable commission. Sellers may request payout to a Zambian bank account or mobile money wallet in their registered name.

10. Disputes between users

Buyers and sellers should first attempt to resolve disputes through ZamBuy's in-platform messaging. If unresolved, either party may raise a formal dispute via the order page and ZamBuy will mediate based on the evidence provided. Our mediation does not waive your statutory rights under the Competition and Consumer Protection Act, 2010.

11. Intellectual property

The ZamBuy name, logo, code and design are owned by Edutech Computers Ltd. By uploading content (photos, descriptions, reviews) you grant us a non-exclusive, royalty-free licence to host, display and promote it on the platform. You retain ownership of your content.

12. Acceptable use

You agree not to:

  • Post false, misleading or fraudulent listings or reviews.
  • Harass other users, send unsolicited bulk communications, or attempt to bypass the first-5 auction.
  • Use the platform to commit any offence under the Cyber Security and Cyber Crimes Act, 2021.
  • Scrape, copy or reproduce listings or user data without written permission.

13. Limitation of liability

To the maximum extent permitted by Zambian law, ZamBuy and Edutech Computers Ltd are not liable for the quality, safety, legality or delivery of goods and services sold by third-party sellers, for losses arising from your dealings with other users, or for indirect or consequential losses. Nothing in these Terms limits liability that cannot lawfully be excluded.

14. Suspension and termination

We may suspend or terminate access to any account that we reasonably believe has breached these Terms, posed a risk to other users, or violated Zambian law. You may close your account at any time by contacting us.

15. Changes to these Terms

We may amend these Terms from time to time. Material changes will be posted on the site and, where possible, communicated by email at least 14 days before they take effect. Continued use of ZamBuy after that date constitutes acceptance.
